Orochimaru accepted immediately, but Jiraya and Itachi refused. 4th doesn't want to go against the will of his old sensai, but he did not give up on young Itachi. (i think there is a time lag between inviting oro and Itachi) 4th threatens to kill the Uchiha clan, Itachi still wont give in. thus 4th sends #2 ranked Akatsuki "white tiger" to murder most of Uchiha clan. Seeing that he is no match to Akatsuki, Itachi agreed to join if "white tiger" would spare Sasuke. Itachi want his brother to became stronger than him, thus lied about the family's death, hoping to let Sasuke's anger to become his strength. Itachi then joined Atatsuki as #3, Orochimaru as #5.

when the fourth "died" lets assume that is when he "left" konoha, uchiha itachi hasnt even graduated from the acadamy yet, because at this time sasuke is just born, and itachi isnt that much older...

the timeline doesnt agree with itself.

we have been shown that orochimaru left konoha a long time ago, when he aws still young and still coudlnt do body transfer jitsus yet.
yet at the time fourth was last seen in konoha, orochimaru was already 40+ years old.

The most favourable theory is that the leader is Uchiha Obito.... None of these theories have been proven yet and my suspicion is that it is someone we have never seen and the manga is just meant to keep us hanging

I think kishimoto is messin with us by highlighting the dude's eye this much... theories say he's either obito or some relation to kabuto.. the truth is no1 knows what the hell is going on and it's ALL speculation till we see it and by the looks of things it wont be too long :D

Obito has 1 eye lose to kakashi that other was squashed by a stone.
His fece must be too squashed and the eye that the leader have is not looking like that.So no one of the two can be it.

every single one of them had the same voice adding mystery to all the members

once they are shown in person like they did itachi and Kissame then you will be able to determin if its a manly voice or a female voice.

Same here. I think Itachi wants Sasuke to surpass him. Not to kill him but to aid him in defeating someone else. Why would Itachi use mang. sharingan against Sasuke in the apartments with Jiraiya and Naruto when he already knows that he'd likely die in a fight with Jiraiya. Especially after having just used the technique against Kakashi. He realized Sasuke still wasn't strong enough and put him through the pain again to make him more determined to leave his friends and seek more power.

After rewatching some of the Naruto episodes I just realized something. Orochimaru says that he avoided killing Naruto when he had the chance during the chunnin exams because he knew the Akatsuki wanted him. Hmm I wonder if that's supporting this theory.. or if the person that wrote this theory just took what Orochimaru said and used it to come up with their idea.

Maybe Orochimaru was just worried the Akatsuki will come after him if he killed Naruto? Shrug.

I think Oro spared Naruto because he didn't care of Akatsuki had him or not. I don't know what terms he left the organization under, but since Akatsuki hasn't been trying to hunt him down I'd imagine they were rather cordial.

Uh, didn't the 4th die to save Konoha from Kyuubi? Also, if the goal of the Akatsuki is to get the demons, why would the 4th seal the Kyuubi inside Naruto and leave Naruto in Konoha so he could eventually grow up to oppose the Akatsuki? This whole "Akatsuki's leader is the 4th Hokage" deal is almost as ridiculous as "Akatsuki's leader is Uchiha Obito."
