So I ordered a new golf driver from a golf shop. They accidentally made two orders. I only got one and they want to charge me twice. I report my card that was charged for the initial purchase lost so they can't screw me. I get a phone call today that they'll take me to small claims court...wtf!

They left messages saying that they had accidentally shipped two orders to my house days after the second driver was delivered. I'm not gonna actively look for another package when I already received one. And my first package was left in front of the my front door which never gets used! I live in a townhouse w/ a garage at the back of the townhouse. I always enter my house from my garage.

Oh man if I do go to court, hope my argumentative side comes to play nicely. Wish me luck.

there is no fucking way you are gonna pay for the second one. it is not your fault nor your business to care about it.

well was it signed for, did they leave a slip, tracking number etc.

also do you have your original purchase slip. does it say you ordered one or two items, if its only one and they decided to ship two then you aren't at fault.

by original purchase slip i mean like an online one that you got a confirmation for if it was an online purchase.

Yeah, as long as you can prove you only ordered one club and not a second then no worries. They need to prove you ordered two for it to even matter. You didn't authorize a second club and if the other one shows up then just give it back so you aren't stealing. I can't believe they're going to take you to court over something like that. Well...I can believe it with the stupid shit I see on court TV sometimes, haha.

Good luck though. Judges don't always side with who can prove what. My parents took one of the apartment complexes we lived in to court. They tried charging us like $1000 after we moved out for some stupid stuff. My parents proved the complex was breaking the law, but in the end the judge didn't make them pay us for the deposit they basically stole and proved they did so. My parents ended up spending more money on the whole thing. Gotta love the legal system...especially when it doesn't work.

I was talking out loud all night yesterday as if I was a trial lawyer defending my positions...lol. I'll probably post what I'm planning to say in this thread to get some feedback too. ;)

Yeah I have evidence that I ordered for only one club. The voice mails they left on my answering machine openly admit they made a mistake in "double ordering" my one order. Why would I need two identical clubs anyways, I'm no pro golfer...haha.

After reviewing my evidence and talking over my argument yesterday I feel pretty confident that I have a decent defense but as stalker mentioned there are lot of downside to going thru the legal system. For example a lot depends on the judge you get assigned. Who knows? This judge could be a friend of this golf shop asshole and it might not matter what I say. That better not be the case! I'll be so pissed off then. This is worrying me a little bit because this asshole said it isn't the first time they've been to small claim cases so I just have to get myself best prepared as I can.

I only have one tracking number, it is written in the packaging label on the box for the first driver that was delivered. I think I need to call fed-ex and try to get the tracking number for the second package that was supposed to be delivered too. I'm assuming it was left on my front door the same way as the first one.

I also looked up the status of my first package online and it says right on that page that the package was left on my front door. I obviously picked this one up right away since I was expecting that package.

Who knows if the second one was ever left on my front door and if it did, how long it stayed there?

And this leads to a key analogy that I plan on making in court if I'm forced to go:

Lets say I leave a valuable in front of a neighbor's front door without letting the neighbor know that I'm doing this. Since that valuable is left in front of the neighbor's house now, does the ownership responsibility of that valuable suddenly get transfered from me to that neighbor? That's the case that Mr. Josh is essentially making.

Hopefully I'll be able to get in my hands the tracking results for that supposed second shipment. It will most likely say the same thing and say it was left on my front door that I hardly ever access. Of course I'll take pictures of my house to show the entry point of my house is 99% of the time from my garage. As long as tracking result for the seconds package is similar to that of the first I think I'm in good shape since the first result says no one signed for the package either and obviously no one signed for the second one.

if judge is a friend of club seller you can ask for another one since current one is biased.

and what about your legal bills? are your paying for your lawyer? if yes. if you win will they pay all your legal cost?

if you are using a lawyer you can do a counterclaim. i believe you can even do one if you aren't using a lawyer, like saying that you are losing a day's worth of pay.

sorry you have to go through so much bs for a mistake they made NNT. going to court is expensive on its own, and so unnecessary since you're obviously in the right O_O

good luck, hope it doesn't come to that. I almost went to court once, but I'd already been through so much hell, and I really didn't think I could face the ones at fault... also I was told that somehow because I had myspace I would lose it despite their obvious fault and the evidence :confused:. The point is, court is not a great place to go... and it's sad that in the US at least, the expense (emotional and financial) more often than not limits justice except for the rich. And that victims are forced to sit across from their victimizers and listen to them recall word for word everything that they did (as my cousin was forced to do) and that our justice system is seriously this corrupt and inhumane. I understand that this is to prevent people from just falsely accusing others, but it probably doesn't even do that much and prevents people from coming forward and thus instigates more crimes.

Sorry, haha, turned into a discussion on problems with the justice system :P

Point is, hope you don't have to go, especially for something so minor, stupid, and obviously the fault of the other party. Maybe take one of those clubs to their heads instead. Then you'd have a real court case. haha.

I don't think you can use a lawyer for small claims court, they just help you with the prep work pre-trial, but yea, remember to bring the one driver they sent you in for evidence, that way if you lose, just grab the driver and go Spartan on their ass:fencing:

Thanks for the support everyone. I'll keep everyone posted on its progress. So far I didn't get any letters telling me to show up to court.

What's funny is that I sort of do want to court now. I can't wait to argue my case and give that asshole a smirk after winning my defense. But if I lose...oh my ego...lol. I might have to go crawl into a hole after that. ;)

ok, here are several things.

1. you can have an attorney if you want it.
2. you can file a counter-claim
3. have the proof of the documents stating how you only ordered one etc.
4. you can bring up the point that the item was just left at your residence but was never actually signed for.
5. the more documents you have stating you have only ordered 1 item the better.

Depends on what insurance u have. If you have collision and comprehensive, it does cover stolen vehicles.

I have neither since mine is quite old. I was trying to get another couple years out of that car too...sigh.

All I can do is wait for the car to be found by the police but I'm not expecting much.

I had the option to have some fun with my stolen car (integra gsr) but I'm getting older and don't drive as aggressively as I used to.

yes i reported the car stolen but haven't heard anything back yet. I'm assuming my car was taken for its parts. Probably the parts by themselves is worth more than the selling the car as a whole itself.

I've been researching cars since my car was stolen. I found a great deal for a TSX being sold by a private seller. Going to see it tonight. Hope my search is over!

The price was too good to be true...lol. So I saw 2 more cars today...a civic and a TSX. Civic was 3,800 cheaper than the TSX...drove me nuts deciding which one to choose. Value versus style. I hope I don't regret my choice later...lol.

I'm so glad my car search is over now though...exhausting to try to get a car in like a week and not get ripped off.
